The potential distributor acknowledges that, as part of the distributor application process and once a distributor of fuji spray®, fuji spray® may disclose to the potential distributor certain confidential information (including without limitation pricing, account details, marketing programs, product information, and intellectual property). The potential distributor acknowledges and agrees that all such confidential information shall be kept strictly confidential by the potential distributor and shall not be disclosed by the potential distributor without the prior written consent of fuji spray®. The potential distributor acknowledges that fuji spray® reserves all legal rights in respect of a breach of this confidentiality covenant, and that fuji spray® may choose to terminate the distribution relationship in the event of a breach.
